Vakıflar Bakanlığının çalışmalarını düzenleyen 2018 tarihli 31 Sayılı Kanunun 35/A maddesi, Cumhuriyet Müftünün kararname ile üç yıllık bir süre için atanmasını öngörmektedir.
Yasanın doğrudan etkisi uyarınca, mevcut Başmüftü’nün görev süresi, söz konusu yasanın yürürlüğe girmesinden bu yana üç yıllık görev süresinin sona ermesi nedeniyle, mevcut MS 2021 yılı için geçen 11 Ekim’de sona eriyor.
Yenilenmesi için herhangi bir kararname çıkarılmamış olması, görevinin sona erdiği ve kanuna göre artık başmüftü olmadığı, ayrıca yetmiş yaşını doldurduğu, yani yaşının da aşıldığı anlamına gelir. yasal yaş.

نصت المادة رقم ٣٥/أ من القانون /31/ للعام 2018م الناظم لعمل وزارة الأوقاف على أن مفتي الجمهورية يعين بمرسوم لمدة ثلاث سنوات.
وعملا بالأثر المباشر للقانون فإن ولاية المفتي العام القائم تنتهي حكما بتاريخ ١١ تشرين الأول الماضي للعام الحالي 2021م نظراً لمضي مدة السنوات الثلاث على وجوده في المنصب منذ نفاذ القانون المذكور.
وإن عدم صدور أي مرسوم بالتجديد له يعني أنّ ولايته قد انتهت ولم يعد مفتياً عاماً بموجب القانون، يضاف إلى ذلك أنه قد بلغ من العمر أكثر من سبعين عاماً أي أنه قد تجاوز السن القانوني أيضاً.
